Terms of Service

These Terms of Service govern all services provided by Peak Performance LA, including in-person training, virtual coaching, and self-directed online programs. By purchasing, booking, or using any service, agreement to be bound by these Terms of Service is confirmed.

1. Services

Peak Performance LA provides personal training, nutrition coaching, and fitness programs delivered in-person, virtually, or online. Service details, structure, and inclusions are outlined in individual program descriptions.

Certain nutrition coaching services require the use of a third-party tracking application for progress monitoring. Clients are responsible for accurately logging their nutrition data and either sharing app access or providing weekly reports as required for coaching review.

Peak Performance LA may update or change supported tracking methods at any time to improve service delivery.

2. Payment Terms

  • All services must be paid in advance unless otherwise agreed in writing.
  • Accepted payment methods include cash, Zelle, and credit card (processing fees may apply).
  • Payment is required regardless of attendance, participation, or completion once a session or program is booked.
  • All scheduled sessions are billable, including completed sessions, late cancellations, and no-shows.
  • If a session is booked and not attended, the client remains responsible for full payment. If payment has not been collected in advance, the client agrees to fulfill the payment obligation upon request.
  • Sessions held on a recognized holiday are subject to a 20% holiday surcharge on the standard session rate. The session itself is billed as usual through the booking system; the surcharge is payable separately via Zelle.
  • Peak Performance LA reserves the right to change session, package, and program pricing at any time. Price changes apply to new bookings, purchases, and renewals and do not affect an active Program until it renews or a new Program is purchased.

3. Session Details

Training sessions are offered in three standard durations: 30 minutes, 45 minutes, and 55 minutes, unless otherwise specified.

Sessions may take place at designated private facilities, partner gyms, residential locations, or virtually, depending on the program.

4. Commitment to Health

By engaging in services, clients acknowledge they are voluntarily participating in physical training and are responsible for ensuring they participate safely and disclose any relevant medical conditions.

5. Program Renewals, Expiration & Extensions

Program Applicability
This section applies to all services and offerings provided by Peak Performance LA, including but not limited to all training packages, transformation programs, kickstart programs, elite programs, hybrid packages, and any other individually named or customized coaching offers ("Programs").

Program Renewals
Programs renew based on the terms agreed to in the original signed agreement at the time of initial purchase, regardless of the method of subsequent renewal or payment. This includes, but is not limited to, renewals processed through the booking system, direct payment methods (such as Zelle, cash, or other off-platform payments), or manual session credit allocations. All renewals are subject to the original Program terms unless otherwise confirmed in writing by Peak Performance LA. Pricing for renewals is governed separately under Section 2 (Payment Terms) and is not fixed by the original Program terms.

Monthly online programs automatically renew unless canceled in writing. See the Cancellation Policy below for the required notice, submission, and confirmation process.

Program upgrades or downgrades take effect at the start of the next billing cycle unless otherwise agreed in writing.

Program Expiration
Each Program includes a defined validity period and expiration date, which is clearly communicated at the time of purchase or enrollment. Clients are responsible for completing all sessions and program deliverables within the stated program timeframe.

All Programs expire automatically at the end of their designated validity period. Any unused sessions, services, or deliverables do not roll over beyond the expiration date and are forfeited upon expiration.

Extensions & Holds
Extensions may be granted in cases of long-term illness or injury, extended travel, or work-related obligations (e.g., filming, relocation, or similar professional commitments).

All extension requests must be submitted in writing and must include a proposed return date. Approval of any extension is at the sole discretion of Peak Performance LA and is not guaranteed.

Approved extensions are intended only for reasonable, time-defined interruptions and are not open-ended. All Programs must resume and be completed within the approved extended timeframe.

Online / Premium Online Programs (Monthly Access, Sessions & Submissions)
For Premium Online Programs or any online coaching packages that include monthly training sessions, live coaching access, or video submission feedback:

  • All included monthly sessions and services must be used within the same billing month in which they are issued.
  • Unused sessions do not roll over into subsequent months and are forfeited at the end of each billing cycle.
  • Video submissions, form check-ins, or feedback requests must also be submitted within the same billing month of enrollment or renewal to be valid.
  • Peak Performance LA is not responsible for initiating scheduling, reminders, or prompting submissions. It is the client's responsibility to proactively schedule sessions and submit materials within the active billing period.

6. Cancellation Policy

  • Individual sessions require at least 24 hours' notice to cancel or reschedule. Late cancellations or rescheduling will result in forfeiture of the session.
  • A 48-hour cancellation notice is required for Monday sessions and sessions before a holiday.
  • Monthly subscriptions may be canceled with at least five (5) business days' written notice before the next billing cycle. Cancellation requests must be sent to info@peakperformancela.com and are only effective upon confirmation.

7. Scheduling & Attendance Policy

Clients are provided a 10-minute grace period from the scheduled session start time.

  • Arrivals within the grace period will receive the remaining session time.
  • Sessions will not be extended beyond the scheduled duration.
  • Arrivals beyond the 10-minute grace period are considered a no-show.
  • No-shows result in forfeiture of the session.

The trainer reserves the right to leave the training location in the event of a no-show.

8. Refund Policy

Refund requests may be submitted within one (1) business day of purchase, provided no sessions, services, or program access have been used or activated. After this period, all sales are final and no refunds will be issued under any circumstances.

All exceptions require written documentation, reasonable evidence, and approval.

The only exception may be considered in cases of permanent relocation more than 50 miles from the training location. Any such request must be submitted in writing and include reasonable proof of relocation (e.g., updated driver's license, lease agreement, or utility bill). Approval is at the sole discretion of Peak Performance LA.

Approved exceptions, if granted, apply only to unused services.

9. Minors / Age Requirement

Services are intended for individuals aged 18 and older. A minor may only participate with the prior written consent of a parent or legal guardian, who agrees to be bound by these Terms on the minor's behalf and to accompany or authorize the minor's participation as required.

10. Illness & Health Precautions

Clients experiencing a contagious illness, fever, or communicable symptoms are asked to cancel or reschedule the session rather than attend in person; such cancellations are handled under the standard Cancellation Policy. If Peak Performance LA must cancel or reschedule a session due to illness, the session will be rescheduled at no additional cost to the client.

11. Trainer Availability & Substitution

In the event Peak Performance LA is unavailable due to illness, travel, or other circumstances, affected sessions will be rescheduled or, where appropriate and with the client's agreement, held virtually or covered by another qualified trainer. Clients will be notified as soon as reasonably possible.

12. Personal Property

Peak Performance LA is not responsible for the loss, theft, or damage of personal property brought to any training location.

13. Photo, Video & Testimonial Release

By agreeing to these Terms, clients grant Peak Performance LA permission to use their photos, videos, and testimonials for marketing and promotional purposes, including on the website and social media. As a courtesy, clients will be informed before specific material is used. Clients may request that particular material not be used, or be removed, at any time.

14. No Guarantees

Results vary based on individual effort, consistency, genetics, lifestyle, and adherence to the program. Peak Performance LA does not guarantee specific results, outcomes, timelines, or physical changes.

15. Assumption of Risk & Limitation of Liability

By participating in services, clients voluntarily assume all risks associated with physical training, including but not limited to injury, aggravation of pre-existing conditions, and property damage.

To the fullest extent permitted by law, clients release Peak Performance LA, its trainers, and affiliates from claims arising from ordinary negligence in connection with participation in the services. This release does not extend to claims arising from gross negligence or willful misconduct. Clients participate at their own risk.

16. Force Majeure

Peak Performance LA is not liable for any failure or delay in performing services due to circumstances beyond its reasonable control, including natural disasters, government restrictions, facility closures, or other events of force majeure.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms constitute the entire agreement between the client and Peak Performance LA regarding the services described herein, superseding any prior verbal or written agreements or representations.

19. Modifications to Terms

Peak Performance LA reserves the right to modify these Terms at any time. Updates become effective upon posting. Continued use of services constitutes acceptance of revised Terms.

20. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
